RUSTY'S CHIPS, INC. – TERMS OF SERVICE

1. Eligibility & Account Responsibilities

• Age Requirement: You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products from our e-commerce site.
• Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate, current, and complete purchase and account information for all transactions.
  
  

2. Product Presentation & Variations

• Visual Representation: We make every effort to display the colors, packaging, and textures of our potato and tortilla chips as accurately as possible. However, we do not warrant that the physical appearance of the final product will exactly match the imagery on your device screen.
• Product Changes: All descriptions of products, flavor variations, and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to limit sales or discontinue any snack line at any time.

3. Food Safety, Ingredients, and Allergen-Free Statement

• Perishable Nature: Our potato and tortilla chips are perishable foodstuffs cooked in natural oils and fats. Rusty's Chips, Inc. is not liable for product degradation resulting from improper storage conditions post-delivery (e.g., exposure to extreme heat, moisture, or sunlight).
• Allergen and Facility Statement: Our commercial facility does not process any allergens, and our products contain zero major food allergens.
• Dietary and Production Classifications:
  • Gluten-Free Status: All of our potato and tortilla chip products are naturally gluten-free; however, please note that they are not certified by the Gluten-Free Certification Organization (GFCO) or any other third-party certifying entity.
  • Non-GMO Status: Select products within our inventory are certified Non-GMO. Non-GMO certification status is explicitly labeled on a per-product basis on individual packaging and corresponding product pages.

4. Billing, Pricing, and Order Acceptance

• Price Changes: Prices for our chips are subject to change without notice.
• Order Rejection: Receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to refuse, cancel, or limit any order you place with us (e.g., if we suspect fraudulent reseller activity or face sudden inventory shortages).
• Currency: All payments are processed in U.S. Dollars (USD) unless explicitly stated otherwise during the checkout process.

5. Shipping, Handling, and Transit Conditions

• Bag Settling & Breakage: Potato and tortilla chips are fragile. Some settling of contents and breakages are natural byproducts of parcel shipping and transit vibration. By placing an order, you acknowledge that crushed or broken chips do not constitute a "defective product."
• Delivery Scope: We ship to addresses within the United States. Risk of loss and title for the products pass to you upon delivery of the items to our third-party shipping carrier.

6. Returns and Refunds

• Policy Reference: All purchases made through our online store are subject to our comprehensive return, refund, and replacement policies. 7. Limitation of Liability and Regulatory Compliance

• California Operations: Rusty's Chips, Inc. is proudly operated out of California. In accordance with state guidelines, the Company maintains safe production practices and qualifies for standard small-business regulatory exemptions regarding localized warning provisions.
• Liability Cap: To the maximum extent permitted by applicable law, Rusty's Chips, Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our site, shipping delays, or the consumption of our products outside of our explicitly listed safety and storage parameters.
